Marijuana is grown for recreational and medicinal uses, most centered around the plant’s makeup of high levels of THC and lower levels of CBD.

THC, tetrahydrocannabinol, is the psychoactive compound found in marijuana. In simple terms, it’s what gets you high.

In order to protect us all from the “dangerous” effects (a discussion for another day!) of THC, the Federal Government has set the legal allowable limit for THC at 0.3%.
Do Hemp CBD and Marijuana CBD both contain THC?
Yes.
However, the main difference between Hemp CBD and Marijuana CBD lies in the amounts of THC.
CBD Oil derived from Hemp falls below the government’s legal limit of 0.3% THC. CBD oil derived from Marijuana does not.
Marijuana CBD oils are capable of obtaining very low amounts of THC, to the point where there may not be any noticeable psychoactive effects, but they still do not fall under the government’s set legal limit of 0.3% THC.

Well, it depends where, and who you ask!
Because of the limits discussed above, any product containing more than 0.3% THC is federally illegal in the United States.
Many states have passed laws allowing for the legalization of products with higher levels of THC, for either medicinal use, recreational use or both. However, in all of these states, the use of THC is still federally illegal.
This makes CBD derived from Marijuana federally illegal in all 50 States. However, it may be legally recognized on the state-wide level (currently legal in 29 states).
CBD Oil derived from Hemp falls under the 0.3% federal limit, and therefore is legal in all 50 states!

If you live in a state like Colorado, you can easily walk into a marijuana dispensary and have your choice of products, from Hemp or Marijuana based CBD oils, to just about any other product you’d like!
